AGENDA CAPTION:
Consideration of and action on authorization of a Contract between the City of Sugar Land, Texas and Associations of First Colony, Inc., in the amount of $288,762.27, for right-of-way landscape and maintenance supplementation.
RECOMMENDED ACTION:
The Public Works Department recommends that the City Council approve the Right-Of-Way Landscaping and Maintenance Contract with Associations of First Colony, Inc., for the landscape supplementation in the amount of $288,762.27 for FY23.
EXECUTIVE SUMMARY:

The City’s Streetscape Policy (“Policy”) gives guidance to the construction and maintenance of the City’s streetscapes. The Policy, adopted on October 19, 2021, provides for the distribution of the City’s Landscape Supplement Program (“Program”) along Signature routes, as defined by the Policy. The Public Works Department administers the program. Annually, the City Council may approve funding for the program as part of the City’s budget that will be available to HOAs or other entities that maintain landscaping on City-owned right-of-way (ROW) at the Signature level.
 
The program is funded in the FY23 budget and provides landscaping supplementation for Ashford Lakes Community Improvement Association, The Avalon Community Association, Barrington Place Homeowners Association, The Commonwealth Civic Association, Gannoway Lake Estates Association, Glen Laurel Homeowners Association, Greatwood Community Association, New Territory Residential Community Association, Sugar Creek Homes Association, Sugar Lakes Homeowners Association, Sugar Mill Community Association, Telfair Community Association, and Association of First Colony (AFC) which consist collectively of Chimneystone Planned Community Development Homeowners Association, Colony Grant Homeowners Association, First Colony Community Services Association, The Community Association of the Highlands, Settlers Park Homeowners Association, and Sugarwood Community Association.
 
The supplement amount is based on the number of square feet of ROW maintained by the entity at the rate that the City pays for right-of-way maintenance. In order to be eligible for the supplementation, the HOA must maintain the landscape at or above the City’s standards as provided in the Streetscape Policy.
 
The Right-of-Way Landscaping and Maintenance Contract with the Associations of First Colony is for FY23, effective on the latest of the dates signed by the parties to September 30, 2023, in the amount of $288,762.27, which will be paid in quarterly installments providing that the minimum landscape standards are being met.
 
The Public Works Department recommends that the City Council approve the Right-Of-Way Landscaping and Maintenance Contract with Associations of First Colony, Inc., for the landscape supplementation in the amount of $288,762.27 for FY23.
