AGENDA CAPTION:
Consideration of and action on authorization of a Construction Contract with Millis Development & Construction LLC, in the amount of $1,415,907.72, for the construction of Cullinan Park Improvements - Phase II, CIP CPK2001; and authorization of a budget amendment in the amount of $200,000.00 to revenues and expenditures for the TPWD Recreation Grant.
RECOMMENDED ACTION:

Consideration of and action on authorizing execution of a Construction Contract in the amount of $1,415,907.72 with Millis Development & Construction, LLC, for the Cullinan Park Phase II Site Improvements, CIP PK2001, with funding from the Cullinan Park Conservancy and Texas Parks and Wildlife Department Recreation Grant and a budget amendment in the amount of $200,000 to both revenues and expenditures for the TPWD Recreation Grant. 

EXECUTIVE SUMMARY:

On May 19, 2015, the City of Sugar Land ("City") and the Cullinan Park Conservancy ("Conservancy") entered into a Memorandum of Understanding ("MOU") regarding financial contribution and development of Cullinan Park ("Park"). On or about June 22, 2015, the City of Sugar Land ("City"), City of Houston ("Houston"), Houston Parks Board, LGC ("HPB"), entered into an Interlocal Agreement ("Agreement") for the operation, maintenance and construction of permanent improvements for the Cullinan Park at Oyster Creek. On January 19, 2016, the City annexed the Park (754.829 acres of land) by adopting Ordinance 2039.
 
Since the execution of the MOU, the Conservancy has raised a total of $2,733,847.49 (including the donation on October 4, 2022) for capital improvements of the Park including Phase I and Phase II design and construction. The Phase I was completed in Fall 2019. The Conservancy, Parks and Recreation Department, Engineering Department and TBG ("Consultant") completed the design and construction documentation for Phase II by May 2022.

An Invitation to Bid for Cullinan Park Improvements Phase II, CPK2001 was advertised on June 15, 2022, June 22, 2022, and June 29, 2022. Bids were opened on July 14, 2022, and the City received five (5) bids for the project.

The responsible low bidder is Millis Development & Construction, LLC, with a base bid of $1,415,907.72. The Consultant's estimate of probable construction cost is $786,255.83. Observing the inflation and market conditions, the Consultant and staff recommend awarding the contract to the responsible low bidder, Millis Development & Construction, LLC.

 

The Conservancy is donating $1,237,000.00 to the City for the project construction on October 4, 2022. City of Sugar Land is able to fund $200,000 with the anticipation of the reimbursement from Texas Parks and Wildlife Department Recreation Grant after the construction is complete. There is $43,969.29 left from the previous CPC donations. In summary, there is $1,480,969.29 available in CPK2001 for Phase II construction. 

 
Staff recommends the City Council authorize the execution of a construction contract with Millis Development & Construction, LLC, in the amount of $1,415,907.72 for the Cullinan Park Phase II Site Improvements, CPK2001 with a budget amendment in the amount of $200,000 to both revenues and expenditures for the TPWD Recreation Grant.
