Consideration of and action on authorizing execution of an Interlocal Agreement with Fort Bend County Levee Improvement District No. 7 regarding access to drainage outfalls for maintenance purposes, and construction and maintenance of drainage outfalls located under a levee.
RECOMMENDED ACTION:

Consideration of and action on authorizing execution of an interlocal agreement with Fort Bend County Levee Improvement District No. 7 regarding access to drainage outfalls for maintenance purposes and construction and maintenance of drainage outfalls located under a levee. 

EXECUTIVE SUMMARY:
The Public Works Department is responsible for the maintenance of the storm sewer system within the City Limits. This includes all inlets, catch basins, storm manholes, pipes, and outfalls. The City of Sugar Land has multiple drainage outfalls that discharge into Levee Improvement District No. 7 Facilities. A total of 42 drainage outfalls were constructed by the New Territory MUD's to provide drainage for public streets and property within New Territory. These outfalls are along and across various portions of LID No. 7 property.

As part of annexation, staff began discussing the need for an interlocal agreement for access to certain drainage outfalls within Fort Bend County Levee Improvement District No. 7. As a result, the attached agreement allows for access, maintenance, and/or replacement of the outfalls as needed. The agreement is structured with an initial term of ten years with successive automatic five year renewals unless terminated earlier. In addition the agreement also establishes a cost sharing agreement for outfalls that penetrate the LID No. 7 levee.

On April 5, 2018, Fort Bend County Levee Improvement District No. 7 executed the agreement at their monthly meeting.

The Public Works Department recommends the approval of the Interlocal Agreement between the City of Sugar Land and Levee Improvement District 7 for access to drainage outfalls for maintenance purposes.
