SECOND CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2288: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS AMENDING THE CODE OF ORDINANCES BY AMENDING CERTAIN PROVISIONS IN CHAPTER 3, ARTICLE IX (SOLID WASTE, RECYCLABLE MATERIALS AND VEGETATION) AND CHAPTER 2, ARTICLE V, DIVISION 4 (FEES FOR VARIOUS CITY SERVICES) AND OTHER MATTERS RELATED THERETO.
RECOMMENDED ACTION:
Approve the second reading of Ordinance No. 2288, which amends the Code of Ordinances by amending certain provisions in Chapter 3, Article IX (Solid Waste, Recyclable Materials and Vegetation) and Chapter 2, Article V, Division 4 (Fees for Various City Services). 
EXECUTIVE SUMMARY:

On March 15, 2022, the City of Sugar Land City Council reviewed recommendations submitted by the Solid Waste Task Force, a 16-member resident task force appointed by the City Manager to develop recommendations for the future of solid waste and recycling in Sugar Land. At this meeting City Council provided direction on many of the recommendations which would require ordinance modifications. 

 

On September 6, 2022, the City of Sugar Land City Council approved a 10-year Solid Waste and Recycling Services Contract, which extends the City's partnership with Republic Services. The new Solid Waste and Recycling Services Contract included service changes that require ordinance modifications before the contract implementation date on January 16, 2023. 

 

The following ordinance modifications are presented for City Council approval: 

 

  • Updating definitions to match the City's Solid Waste and Recycling Services Contract 
  • Restricting the collection schedule for commercial properties within 1000 feet of a residence 
  • Updating green waste collection requirements to include the new clear bag requirement 
  • Updating bulky waste collection requirements to include the new on-demand, flexible service 
  • Removing the commercial exemption that was included previously for the purpose of annexation 
  • Updating the license fee for the City's Commercial Solid Waste Operator Program

 

These ordinance modifications are the final step in the 18-month Solid Waste and Recycling Contract Sequence that began in Summer 2021. 

 

A public hearing and first reading of Ordinance No. 2288 were held during the December 20, 2022 City Council Meeting.

 

The Environment and Neighborhood Services Department recommends that the City Council approve the second reading of Ordinance No. 2288, which amends the Code of Ordinances by amending certain provisions in Chapter 3, Article IX (Solid Waste, Recyclable Materials and Vegetation) and Chapter 2, Article V, Division 4 (Fees for Various City Services).
