PUBLIC HEARING 5:30 P.M.: Receive and hear all persons desiring to be heard on a proposed Conditional Use Permit for Animal Services, Boarding & Day Care for a K9 Pet Resort facility at 14033 Southwest Fwy. Further described as 0.23 acre portion of the 10.4044 acre Commercial Reserve ‘A’ of The Park at Sugar Creek. 

 

FIRST CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2293AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS,GRANTING A CONDITIONAL USE PERMIT FOR AN ANIMAL SERVICES,BOARDING/DAYCARE (K9 RESORTS) LOCATED AT 14033 SOUTHWESTFREEWAY, ON AN APPROXIMATELY 0.23 ACRE PORTION OF THE 10.404 ACRESOF COMMERCIAL RESERVE “A” OF THE PARK AT SUGAR CREEK, WITHIN THEGENERAL BUSINESS (B-2) ZONING DISTRICT.

RECOMMENDED ACTION:
Hold the public hearing followed by first consideration of Ordinance No. 2293.  Staff and the Planning & Zoning Commission support approval of granting a CUP for an Animal Services Boarding/Daycare use located at 14033 Southwest Freeway.
EXECUTIVE SUMMARY:

This is a Conditional Use Permit (CUP) request for a proposed Animal Services, Boarding & Day Care facility for the existing 9,750 square-foot building located at 14033 Southwest Freeway, Suite 705. The site is located in the Sugar Creek commercial retail center at the northeast corner of US 59 Southwest Fwy and South Parkway Boulevard. The property was annexed in 1984 and subsequently zoned as B-2, General Business, which requires a CUP for Animal Services, Boarding & Day Care. The existing building has been most recently used as a watch and jewelry store and was developed as part of a larger retail center. The site will utilize excess parking to build the outdoor pet area and has a shared parking agreement with the overall shopping center that meets minimum parking requirements for the entire site. This commercial retail center is also zoned as B-2, General Business, with medium to high intensity uses with which an Animal Services, Boarding & Day Care use is compatible.
 
This property is identified in the Future Land Use Plan as a “Neighborhood Activity Center.” This category is meant to serve as small commercial centers that act as a “main street” for nearby neighborhoods and are mixed-used and walkable. Neighborhood Activity Centers can include retail, office space for small companies and professionals, and compact forms of residential. Although the land use, location, and development are all proposed to be codified, the brand of K9 Resort is not part of the codification. In the future, if a different Animal Services, Boarding/Day Care, would like to move in, that use would be allowed if all approved CUP conditions are being met. 
 
Planning & Zoning Commission held a Public Hearing on January 26th, 2023, at which no speakers were present. After the close of the public hearing, the Commission held discussion and direction and chose to table Consideration & Action at a subsequent meeting. The discussion revolved primarily around the type and quality of proposed fencing, the maximum number of animals allowed at one time, waste management, the operational staffing of the business, and noise impacts on neighbors. Staff followed up with information from Sugar Land Animal Shelter staff and further clarifications. After the presentation of the additional information during the February 14th P&Z meeting, the Commission voted to Recommend Approval of the Conditional Use Permit with the following conditions:

 

  1. Site to be developed in accordance with the attached Site Plan, Landscape Plan, and
    Elevations; and
  2. All daycare areas will meet the minimum size requirements of 12 sq.ft. for small dogs and
    18 sq.ft. for large dogs.

 

This item is scheduled for a Public Hearing followed by first reading of Ordinance No. 2293 granting a Conditional Use Permit for an Animal Services, Boarding/Daycare use to be located at 14033 Southwest Freeway.
