On January 17, 2023, City Council approved a contract with Aclara Technologies LLC (Aclara) for the advanced metering infrastructure project, CIP CWA2210.
 
Subsequent to the approval by City Council, Aclara informed City staff that they were unable to procure the insurance certificates, endorsements, and performance and payment bonds required by RFP 2022-10 and Texas law unless the specific requirements and dollar amounts were listed as an exhibit to the contract.  
 
This Amendment No. 1 specifically states that Aclara is required to procure performance and payment bonds in an amount equal to the cost of the contract, and if the contract cost is increased by change order, Aclara is required to procure new performance and payments bonds to cover the increase in cost.
 
Additionally, an exhibit is included with Amendment No. 1 detailing the exact insurance requirements (dollar amount and endorsements). Included within this Exhibit is an acknowledgment of Aclara as to the insurance requirements. This acknowledgment was submitted by Aclara when they submitted their bid.
