SECOND CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2322: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS, AMENDING THE CODE OF ORDINANCES BY REVISING CHAPTER 3, ARTICLE VIII (SMOKING IN PUBLIC PLACES) TO LIMIT SMOKING IN CERTAIN ESTABLISHMENTS IN THE CITY.  
RECOMMENDED ACTION:
Consider Second Reading of Ordinance No. 2322 modifying Chapter 3, Article  of the Code of Ordinances to prohibit smoking in Tobacco Bars and exclude Retail Tobacco Stores as a business where smoking is permitted.
EXECUTIVE SUMMARY:

During a City Council workshop on October 24, 2023, staff provided information regarding regulations in the Development Code and Code of Ordinances pertaining to tobacco businesses and associated operational requirements. At that time, City Council instructed staff to present ordinance and zoning modifications that would prohibit future tobacco-related businesses while also limiting smoking in existing businesses.

 

Ordinance No. 2322 is the first phase of amendments and will have an immediate impact on Retail Tobacco Stores. It will also prohibit smoking in Tobacco Bars that begin operating on or after January 1, 2024. Associated zoning amendments will be brought forth at a future meeting.

 

A Public Hearing and First Reading of Ordinance No. 2322 were held during the November 21, 2023, City Council Meeting.

 

The Environmental and Neighborhood Services Department recommends approval of the Second Reading for Ordinance No. 2322 modifying Chapter 3, Article VIII of the Code of Ordinances to amend the locations where smoking is permitted.
