SECOND CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2327AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS, AMENDING CHAPTERS 2 AND 5 OF THE CODE OF ORDINANCES BY AMENDING FEE PROVISIONS LOCATED IN SECTIONS 2-137, 5-248, 5-249, 5-357 AND 5-421, AND ADDING A NEW SECTION 5-422; AND SETTING AN EFFECTIVE DATE.
RECOMMENDED ACTION:
Consider Second Reading of Ordinance 2327 amending various fee sections in the Code of Ordinances.
EXECUTIVE SUMMARY:

Ordinance 2327 contains a number of amendments to fees located in the Code of Ordinances that are necessary to implement the development agreement between the City and Pulte Homes of Texas LLP.

 

The amendments are:

 

  • Chapter 2. A new "fire station" fee is being added. This fee will be charged to each service connection located in the area, subject to the development agreement. 

 

  • Chapter 5. Four fees are being revised, and one new fee is being added.

 

  • Section 5-357 is being amended to allow temporary hauling of wastewater with written approval from the PW Director or their designee.

 

  • Section 5-248 is being amended to reflect the two categories of retail water customers located in the ETJ and the applicate rate.

 

  • Section 5-249 is being amended to reflect the difference in connection fees for development north and south of the Brazos River.

 

  • Section 5-421 is being amended to allow the City to charge a fire protection fee to ETJ properties connected to the City's water system, not just a MUD.

 

  • Section 5-422 is being added to allow the City to charge an emergency medical services fee for providing EMS services to connections in the ETJ. This monthly charge would be in addition to any per-call charges that would be billed under Chapter 2.

 

A Public Hearing and First Reading of Ordinance No. 2327 were held during the December 5, 2023 City Council Meeting.

 

Staff requests approval of the Second Reading for Ordinance No. 2327, amending various fee sections in the Code of Ordinances.
