| | | | | | | | | EXECUTIVE SUMMARY: | On January 30, 2017, a class action lawsuit was filed against the City seeking to invalidate Ordinance No. 1628 (Photographic Traffic Enforcement System) and Transportation Code Chapter 707. The City hired the law firm of Taylor, Olson, Adkins, Sralla & Elam, L.L.P. (TOASE) to defend the City.
On July 24, 2017, the District Court ruled in the City's favor. The plaintiffs have appealed the District Court's ruling.
The original contract was for $49,500. The City Council approved Amendment No. 1 in the amount of $35,000 on October 3, 2017.
This contract is funded from the Red Light Camera Fund; funds will be reallocated within the FY17 budget to cover the contract amount and reduce the amount available to split between the City and the State at year end.
Staff recommends the City Council approve Amendment No. 2 to the City's contract with TOASE, in the amount of $30,000 to cover the costs related to the appeal, for a total contract cost of $114,500.
