Consideration of and action on authorizing execution of a Utility Relocation Reimbursement Agreement with CenterPoint Energy Houston Electric, LLC in the amount of $97,115.34 for State Highway 6 Widening Phase III Brooks Street to Lexington Boulevard, CIP ST1404.
RECOMMENDED ACTION:
Authorize Utility Relocation Reimbursement Agreement with CenterPoint Electric.
EXECUTIVE SUMMARY:

As the SH6 Widening Phase III Project progresses, right of way areas have been acquired as necessary for the improvements to the SH6 Widening Phase III Project (CIP ST1404). The City has acquired 44 parcels along the SH6 corridor and close coordination efforts with utility relocations for the project are ongoing.

Per the Advance Funding Agreement entered into by and between TxDOT and the City, effective June 4, 2015, the City is responsible for the adjustment, removal, and relocation of utility facilities required by the SH6 Phase III Widening Project (CIP ST1404), including the reimbursement of eligible utility relocation costs. The SH6 Widening Project will require the relocation of numerous electric distribution poles impacted from Brooks Street to Lexington Boulevard. Of the impacted poles, ten (10) poles qualify for relocation reimbursement due to their current location within a CenterPoint easement. The City acknowledges that, based on CenterPoint’s interest in the easement, the cost of the work is an eligible relocation cost for which CenterPoint is entitled to compensation. This relocation must occur prior to road construction for the SH6 Widening Project. The terms of the Agreement are based on actual relocation costs provided by CenterPoint.

Under the terms of the Agreement the following was negotiated between both parties:

CenterPoint Obligations:
CenterPoint will submit to the City a detailed statement of its actual costs for reimbursement.

City Obligation:
City will pay Centerpoint for actual costs of the work.

Funding is identified in the City’s Capital Improvement Program under CIP ST1404.

The Engineering and Legal Departments recommend that the City Council approve the Reimbursement Agreement and authorize the City Manager to execute the attached Utility Relocation Agreement with CenterPoint Energy Houston Electric, LLC, for SH6 Widening Phase III Brooks Street to Lexington Boulevard CIP ST1404, in the amount of $97,115.34.
