AGENDA CAPTION:
Consideration of and action on authorizing execution of an Agreement, by and between the City of Sugar Land, Texas and Chimneystone Planned Community Development, Inc., in the amount of $75,000.00 through the Sugar Land 4B Corporation Joint CIP Program, for brick perimeter fencing improvements along Settlers Way Boulevard from Highway 6 to the north side of the Frontier Drive intersection.
RECOMMENDED ACTION:
Review and approve Agreement with Chimneystone Planned Community Development in the amount of $75,000 for a decorative brick perimeter fencing that will extend south along Settlers Way Blvd. from Hwy. 6 to the north side of the Frontier Drive intersection.  
EXECUTIVE SUMMARY:

The Sugar Land 4B Corporation (SL4B) Joint Capital Improvement Program (Joint CIP) is a program for community-based organizations to enhance the community through public improvements projects in which SL4B participation will increase the quality or scope and/or decrease the time of development.

 

On July 18, 2018, the SL4B Board approved Resolution No. 2018-07-12 to allocate $75,000 in FY18 Joint CIP project funding (CIP project PK1801) to the Chimneystone Planned Community Development for their brick fencing improvement project. This project will see that the fencing, which extends south along Settlers Way Blvd from Hwy. 6 to the north side of the Frontier Drive intersection, is replaced with a decorative brick fence, with total project costs anticipated at $152,106. The Joint CIP policy dictates that the maximum funding the SL4B can provide is half the total project costs with a $75,000 maximum limit per project. Additionally, the SL4B updated the Chimneystone funding resolution twice, through Resolution No. 2018-09-19 and Resolution No. 2018-12-23, in order to extend the Chimneystone deadline for completion of required project documentation. Since the HOA had been actively pursuing the required documents and the delays were due to outside parties, the Board was comfortable granting extensions.

 

Now that all documents required in the SL4B resolution have been completed and received by the City, and given that the City Council must approve all agreements over $50,000, the City Council may now consider and approve the agreement with the HOA that outlines the terms for receiving the funds allocated to the project from SL4B. Once the agreement is approved, the HOA can begin work on the project. Payment will be made to the HOA upon the submittal of the completion documents outlined in the agreement. These documents include copies of invoices and receipts that show the anticipated total project cost was actually spent and paid for, photographs of the completed improvements, and copies of any permits gained for the project.

 

With that, the Economic Development Department recommends the City Council approve the agreement between the City of Sugar Land and Chimneystone Planned Community Development to fund the brick fencing improvements along Settlers Way Blvd. from Hwy. 6 to the north side of the Frontier Drive intersection.
