Consideration of and action on authorizing the execution of a Construction Contract with Millis Development and Construction, LLC, in the amount of $141,570.00, with funding provided by the Cullinan Park Conservancy, for the Cullinan Park Section 1, Phase 1, Part III, Aerobic Treatment Unit System, CIP PK1704.
RECOMMENDED ACTION:
Consideration of and action on authorizing the execution of a Construction Contract with Millis Development and Construction, LLC, in the amount of $141,570.00 for Cullinan Park Phase 1 Aerobic Treatment Unit System, CIP PK1704, with funding provided by the Cullinan Park Conservancy.
EXECUTIVE SUMMARY:

On May 19, 2015, the City of Sugar Land ("City") and the Cullinan Park Conservancy ("Conservancy") entered into a Memorandum of Understanding ("MOU") regarding financial contribution and development of Cullinan Park ("Park"). On or about June 22, 2015, the City of Sugar Land ("City"), City of Houston ("Houston"), Houston Parks Board, LGC ("HPB"), entered into an Interlocal Agreement ("Agreement") for the operation, maintenance and construction of permanent improvements for the Cullinan Park at Oyster Creek. On January 19, 2016, the City annexed the Park (754.829 acres of land) by adopting Ordinance 2039.

 

Since the execution of the MOU, the Conservancy has raised more than $1.2 million for capital improvements of the Park. Capital improvements will be done in accordance to the Cullinan Park Master Plan. The Conservancy Planning Committee, Parks and Recreation Department, Engineering Department and White Oak Studio ("Consultant") have developed the preliminary design and construction documentation for Section 1, Phase 1 of the capital improvements project. Section 1, Phase 1 Site Improvements will be done in three (3) parts:

 

  1. Part I: Two trailheads, a new trail, boardwalk, a lake overlook, signage, planting, understory clearing, site furnishing, water utilities, and electrical lines.
  2. Part II: Pre-fabricated restroom.
  3. Part III: Aerobic treatment unit system (ATU) sanitary and sewer system for the restroom.

 

City Council awarded the Part I construction contract to Millis Development and Construction, LLC for $774,615.00 on October 2, 2018.  City Council awarded the Part II restroom contract to Wallis Concrete, LLC for $112,279.27 on December 18, 2018.

The Aerobic Treatment Unit System (ATU) project is Part III of Cullinan Park Section 1, Phase 1 Site Improvements.  An ATU system is a type of septic system for treating wastewater, and due to the remote location of the restroom within the Park, this has been determined to be the most practical system.


The ATU bidding process started in December 2018. The first bidding process yielded only one bid that was approximately 50% more than the allocated budget. City Council approved the bid rejection on February 19, 2019, and the City rebid the project.

The City received one responsive bid from Millis Development and Construction, LLC in the amount of $141,570.00. Staff updated the bid result and recommendation to the Cullinan Park Conservancy, who is responsible for the project funding, and the Conservancy agrees with the recommendation.

The Parks and Recreation Department recommends the City Council authorize the execution of a construction contract with Millis Development and Construction, LLC, in the amount of $141,570.00, for the Cullinan Park, Section 1, Phase 1, Part III Aerobic Treatment Unit System, CIP PK1704.
