FIRST AND FINAL CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2199: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS, ORDERING THE ELECTION SCHEDULED TO BE HELD ON SATURDAY, MAY 2, 2020, BE POSTPONED TO TUESDAY, NOVEMBER 3, 2020, AS ALLOWED BY THE MARCH 18, 2020 PROCLAMATION OF THE GOVERNOR OF THE STATE OF TEXAS; AND MAKING FINDINGS RELATED THERETO.
RECOMMENDED ACTION:
Postpone May 2, 2020 election to November 3, 2020.
EXECUTIVE SUMMARY:

The City Council adopted Ordinance No. 2190 on February 4, 2020, ordering an election for Saturday, May 2, 2020, to elect a Mayor, two Council Members to At-large Positions 1 and 2, and to vote on amendments to the City’s Charter. On March 13, 2020, the Governor of the State of Texas confirmed the Coronavirus (COVID-19) poses an imminent threat of disaster and, declared a state of disaster in every county in the State, per Section 418.014 of the Texas Government Code. 

The Mayor also issued a local public health disaster declaration for the City in response to COVID-19 on March 13, 2020. The City Council, during the March 17, 2020 City Council Meeting, extended the local disaster declaration until March 31, 2020. 

 

On March 18, 2020, the Governor of the State of Texas, then issued a Proclamation suspending certain sections of the Texas Election Code. In particular, allowing political subdivisions scheduled to hold elections on May 2, 2020, the option to postpone their elections to November 3, 2020 (the next uniform election date). In the days that followed, March 19, 2020 - March 29, 2020, the Governor issued an Order regulating the avoidance of gatherings of groups of 10 or more people (as per the President of the United States and the Center for Disease Control); the Fort Bend County Judge issued a "Stay Home to Save Lives Order" effective until April 3, 2020; and the President of the United States announced that social-distancing will continue until April 30, 2020. 

 

The Office of the City Secretary recommends City Council approve Ordinance No. 2199, on first reading, postponing the May 2, 2020 City of Sugar Land General Election and Charter Amendment Election to November 3, 2020.
