Consideration of and action on the appointment of one member to an unexpired term ending September 30, 2021; promotion of one alternate to member, and appointment of one alternate member for terms expiring September 30, 2022; appointment of two members and one alternate member for terms expiring September 30, 2023; and appointment of a Chair, to the Independent Ethics Review Board.
RECOMMENDED ACTION:

Consideration of and action on the appointment of one member to the Independent Ethics Review Board for an unexpired term ending September 30, 2021; one member and one alternate to unexpired terms ending September 30, 2022; two members and one alternate to terms expiring September 30, 2023; and appointment of Chair for term expiring September 30, 2021.

EXECUTIVE SUMMARY:

The Rules of Ethical Conduct were originally enacted on December 20, 2005. In the years since, there have been no written complaints filed.

 

On February 2, 2016, a Citizen's Ethics Task Force was appointed to conduct a ten-year review of the Rules of Ethical Conduct. They held 21 public meetings and presented their recommendations at three City Council workshops (9/6/2016, 2/28/2017, and 3/27/2017). In addition, a fourth workshop was conducted by the City Attorney to review the final draft (5/2/2017).  City Council unanimously approved the revisions to the Rules of Ethical Conduct on May 23, 2017 via Ordinance No. 2095. One of the recommendations found within the update was the establishment of the Independent Ethics Review Board.

 

Resolution No. 18-27 provides for the appointment of the initial members of the Independent Ethics Review Board. The Board, consisting of seven members and two alternates, is charged with reviewing and disposing of sworn complaints alleging violations of the City's code of ethical conduct found in Chapter 2, Article IV of the Code of Ordinances. All members and alternate members must be residents of the city. The Mayor appoints the chair, subject to the council's approval.

The term of office for board members is three years. To establish the initial board, and to provide for staggered terms, the first set of appointments consisted of two members and an alternate appointed to a one year term ending September 2019, two members and an alternate appointed to a two year term ending September 2020, and three members appointed to a three year term ending September 2021.
