AGENDA CAPTION:
Consideration of and action on authorization of an Agreement between the City of Sugar Land and Settlers Park Homeowners Association, Inc., in the amount of $75,000.00 through the Sugar Land 4B Corporation Joint Capital Improvement Program, for brick perimeter fencing in Settlers Park near Settlers Way Boulevard.
RECOMMENDED ACTION:
Review and approve Agreement with Settlers Park Homeowners' Association, Inc., for funding requirements of their FY20/21 Joint CIP project - Perimeter Fencing, in the amount of $75,000.00.
EXECUTIVE SUMMARY:

The Sugar Land 4B Corporation (SL4B) has a Joint Capital Improvement (CIP) Program that provides an opportunity for community-based organizations to enhance the community through public improvement projects in which SL4B participation will increase the quality of the scope and/or decrease the time of development. This program was established through City Council Resolution No. 14-27 and updated in 2020 via Resolution No. 20-03.

 

On January 20, 2021, during the SL4B workshop, the Board recommended moving forward with funding all 11 eligible projects with a total cost of $452,922.59. The remaining $52,922.59 will come from 4B’s Reserve for Opportunity funding.

 

The agreement in consideration is the Settlers Park Homeowners' Association Project which consists of phase one of a brick wall replacement located along the Settlers Park side of Settlers Way Blvd., starting at the monument at Flintwood Dr. and continuing down Wagon Trail. The project's total cost is $168,669.00 with an SL4B contribution of $75,000.00, which was approved by the SL4B board for reimbursement on February 24, 2021, via Resolution No. 2021-02-03.

 

Resolution No. 2021-02-03 outlines various eligibility documentation the Association must submit to the City before an agreement may be brought for City Council consideration. Included in these documentations are a survey, “No Objection” letter or consent to encroachment from each entity with utility facilities located within the Public Utility Easement, and an easement or consent to encroachment from any easement holder or private property owner, showing they do not object to the fencing being located within the easement. These items, along with the execution of the agreement, were originally due on September 30, 2021. However, due to delays in the process, the SL4B Board approved Resolution No. 2021-09-11 in September 2021, extending the deadline to December 31, 2021.

 

Upon approval of the agreement by the City Council, work on the project may begin, and reimbursement will be provided within 30 days of the Association submitting the completion documents outlined above.

 

Staff recommends that the City Council approve an agreement between the City of Sugar Land and Settlers Park Homeowners Association for funding requirements of their FY20/21 Joint CIP project - Perimeter Fencing, in the amount of $75,000.00.
