This is a request for approval of a two-year time extension for a Conditional Use Permit (CUP) to construct a limited service hotel on 1.8 acres located southeast of Sugar Park Lane and U.S. Highway 90A in the General Business (B-2) zoning district. Per the City of Sugar Land’s Development Code, a limited service hotel is defined as “a hotel with guest rooms offered at nightly rates only, that contains the following amenities: (a) a minimum of 500 square feet of dedicated meeting and event facilities; (b) swimming pool; and (c) fitness center.” The proposed limited service hotel will exceed the requirements of the Development Code by providing the following amenities: (a) a minimum of 1,200 square feet of meeting space; (b) a 750 square foot fitness center; and (c) a 1,577 square foot pool room as part of the CUP.
The CUP was recommended for approval by the Planning and Zoning Commission January 10, 2016 and approved by City Council on March 1, 2016 as Ordinance No. 2043.
Under Chapter Two, Article 1, Section 2-25, if a building permit application for construction of the use authorized by the ordinance has not been obtained within two years of the date of the ordinance, the CUP will expire. However, the Council upon receiving written application and the recommendation of the Commission, may grant an extension of time to make use of the CUP.
No changes to the CUP content are being proposed, and under the Development Code, the Council's discretion is limited to approval or denial of the time extension and not a technical re-review of the approved CUP. If the time extension is approved by City Council, the CUP extension would give the applicant until March 1, 2020 to secure a building permit. Staff has no objection to the applicant’s request for a two-year time extension for the approved CUP and recommends approval of a two-year extension from City Council. All requirements from Ordinance No. 2043 would apply.
The Planning and Zoning Commission held Consideration and Action on this request at the January 9, 2018 meeting, where a unanimous recommendation of approval was made to the Mayor and City Council.
