SECOND CONSIDERATION: Consideration of and action on CITY OF SUGAR LAND ORDINANCE NO. 2124, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SUGAR LAND, TEXAS, PROVIDING FOR A CHANGE OF ZONING FROM INTERIM STANDARD SINGLE-FAMILY RESIDENTIAL (R-1-I) DISTRICT TO STANDARD SINGLE-FAMILY RESIDENTIAL (R-1) DISTRICT FOR APPROXIMATELY 425 ACRES FOR THE AREAS NORTH OF HIGHWAY 59 AND SOUTH OF THE BRAZOS RIVER, INCLUDING, BUT NOT LIMITED TO THE RESIDENTIAL PLATS KNOWN AS RIVERPARK SECTION ONE THROUGH THIRTEEN.
RECOMMENDED ACTION:
Second Reading Ordinance No. 2124 for the 425 acre rezoning on First Reading.
EXECUTIVE SUMMARY:

This is a City-Initiated rezoning proposal for the approximate 425 acres of Riverpark Residential area, from Interim Standard Single Family Residential (R-1 I) to Standard Single Family Residential (R-1). The Riverpark area was annexed in 2009 and received Interim Standard Single Family zoning. The commercial areas of Riverpark were permanently rezoned after annexation. Permanent zoning is ultimately needed post-annexation; therefore, the City has initiated the permanent rezoning process for the remaining residential areas of Riverpark.  (As a note, the Enclave at Riverpark was annexed into the City at a later date due to it being undeveloped when the rest of Riverpark was annexed into the City and received permanent zoning prior to it being developed, so it is not included in the 425 acres for this rezoning.)

 

In addition to the notice of this Public Hearing meeting, a letter further explaining the zoning change was sent to the property owners within the Riverpark residential areas and the homeowners association.  Staff has received three informational inquiries at this point in time. Staff believes applying the R-1 zoning district is the most appropriate zoning district for the area and will result in a positive outcome for matching platted setbacks with zoning for the proper regulations for any future construction. This is fully supported in the Comprehensive Plan’s Future Land Use Plan and Map. With regard to the Brazos River floodplain area that is currently zoned R-1 I, staff anticipates recommending the Brazos River Park and Conservation (BR) zoning district for the future permanent zoning and that acreage is not included in this permanent zoning request.

 

The Commission held a Public Hearing on December 12, 2017, where no members of the public spoke and also unanimously recommended approval to the Mayor and City Council for permanent R-1 zoning.
