| | | | | | | | EXECUTIVE SUMMARY: | The Public Works department administers the Right-of-Way Use Permits which regulates the placement of any facility or equipment in the public right-of-way. This may include but is not limited to any kind of underground (public or private), structures, signs, irrigation and approval of any lane closures. In addition, any new aerial facilities that are constructed within the public right of way must be installed in accordance with the minimum heights as described in the International Fire Code.
In the recent past, there have been concerns regarding the installation of overhead lines that are hung or sag too low across City streets and along public rights-of-way. As a result, staff has researched this topic and found that the document that provides the best regulation of these types of facilities is the National Electrical Safety Code (NESC). The NESC will set the minimum height for overhead electric to 18.5 feet and 15.5 feet for overhead communication, cable television and other lines. In addition, the ordinance includes a provision for minimum vertical clearances above any traffic-control sign, signals or devices.
Staff recommends the approval of Ordinance No. 2104 - An ordinance of the City Council of Sugar Land, Texas, Amending Chapter 5, Article III of the Code of Ordinances regarding use of the Public Rights-of-Way by revising the reserved section numbers in Division 2 and adding a new Division 3 regarding the height of overhead lines
