PUBLIC HEARING 5:30 O'CLOCK P.M.:  Receive and hear all persons desiring to be heard on the proposed annexation of approximately 252 acres of land located adjacent to the New Territory Municipal Utility Districts to the  south identified as Tract B (80 acres), Tract C (9 acres) and Tract D (163 acres).
RECOMMENDED ACTION:

Hold first Public Hearing to annex approximately 252 acres of land along the south boundary of the New Territory Municipal Utility Districts.

EXECUTIVE SUMMARY:

The purpose of this agenda item is to hold the first required public hearing for the annexation of approximately 252 acres of land along the south boundary of the New Territory Municipal Utility Districts into the city limits of Sugar Land.

 

The Texas Local Government Code requires the City to hold two public hearings prior to initiation of annexation proceedings (readings of annexation ordinances). This agenda item will satisfy the requirement for the first public hearing, and the second public hearing will be held at the August 1, 2017 City Council meeting. State law also requires that property owners and public entities that provide services in the area proposed for annexation be notified of the annexation prior to the public hearings. Staff sent notification to all property owners.

 

The properties are referenced in the attached map and are known as Tract B (80 acres), Tract C (9 Acres) and Tract D (163 acres). Tract B is approximately 80 acres located south of the New Territory MUDs and includes LID No. 7 levee and drainage facilities associated with the New Territory subdivision, as well as the portion of the Grand Parkway that crosses over the Brazos River. Tract C, approximately 9 acres, encompasses the MUD 112 wastewater treatment plant, which the City will acquire and begin to operate upon annexation of the MUD. Tract D is owned by the New Territory Residential Community Association and includes soccer and baseball fields, and encompasses approximately 163 acres. Both the MUD 112 property and the NTRCA property are included in a development agreement with the City that stipulates that the properties would not be annexed before the rest of the New Territory community.

 

Through the 2016 Non-MUD Annexation Review Program, staff identified four areas for potential annexation concurrent with the New Territory and Greatwood annexation in December 2017. Staff presented the results of the Review Program to the IG Committee on January 17, 2017 and the full City Council on February 21, 2017. The IG Committee recommended moving forward with annexation of three of the four areas at their June 20, 2017 meeting.

 

On June 20, 2017 City Council approved Resolution No. 17-14 which directed the Planning Department to prepare service plans for the properties. Planning staff worked with all departments throughout the service planning process to ensure all possible costs and revenues are considered. The draft service plan is attached to this agenda request.

 

Staff recommends that City Council hold the first public hearing for the proposed annexation of approximately 252 acres along the south boundary of the New Territory Municipal Utility Districts.
