AGENDA CAPTION:

Consideration of and action on authorizing execution of an Interlocal Agreement by and between The Brazos River Authority and the City of Sugar Land, Texas for the Lower Brazos River Flood Protection Plan Study, Phase 2; and authorizing matching funds in an amount not to exceed $30,000.00 for the local participant share of the total Study costs.
RECOMMENDED ACTION:
Approval of the Interlocal Agreement for the Lower Brazos River Flood Protection Plan Study.
EXECUTIVE SUMMARY:

The Brazos River Authority (BRA), on behalf of the City of Sugar Land and other participants, applied to the Texas Water Development Board (“TWDB”) for a planning grant (“Grant”) to develop a flood protection plan for the lower Brazos River (“Study”) affecting the city limits of the City of Sugar Land.

 

The Grant requires the commitment of matching funds to pay for the local share of the total Study costs. City of Sugar Land’s share of matching funds under the Grant shall not exceed a total of thirty thousand dollars ($30,000).

 

Upon completion of the Study, BRA shall provide the City of Sugar Land a copy of the final Lower Brazos River Flood Protection Plan report. Pursuant to Amendment No. 2, the City is a non-exclusive, unrestricted, unlimited, perpetual, irrevocable, world-wide, royalty-free license to use the Contractor Work and Subcontractor Works, as defined in the TWDB Agreement.

 

This Interlocal Agreement for the Lower Brazos River Flood Protection Plan Study (“Agreement”) is made and entered into pursuant to the provisions of Chapter 791 of the Texas Government Code (the Interlocal Cooperation Act) by and between the Brazos River Authority (“BRA”), a river authority of the State of Texas, and the City of Sugar Land (“CITY, as PARTICIPANT”), a municipality of the State of Texas (collectively, the “Parties).

 

The Engineering Department is requesting City Council to approve the Interlocal Agreement between The Brazos River Authority and the City of Sugar Land for the Lower Brazos River Flood Protection Plan Study.


BUDGET

EXPENDITURE REQUIRED:  $30,000.00

CURRENT BUDGET: $15,000.00 (FY 17)

ADDITIONAL FUNDING: $15,000.00 (FY18)
