| | | | | | | | | EXECUTIVE SUMMARY: | On January 30, 2017 a class action lawsuit was filed against the City seeking to invalidate Ordinance No. 1628 (Photographic Traffic Enforcement System) and Transportation Code chapter 707. The City hired the law firm of Taylor, Olson, Adkins, Sralla & Elam, L.L.P. (TOASE) to defend the City.
On July 24, 2017, the District Court ruled in the City's favor. The plaintiffs have appealed the District Court's ruling.
This agenda item is an amendment to the City's contract with TOASE. The original contract was for $49,500. We are requesting an additional $35,000 to cover the costs related to the appeal, for a total contract amount of $84,500.
This contract is funded from the Red Light Camera Fund; funds will be reallocated within the FY17 budget to cover the contract amount and reduce the amount available to split between the City and State at year end.
