AGENDA CAPTION:
Consideration of and action on authorizing execution of a reimbursement Agreement in the amount of $8,894.40 with CenterPoint, LLC for utility relocation of approximately 160 feet of CenterPoint's 6-inch natural gas pipeline for the State Highway 6 Widening Phase III Project, CIP ST1404.
RECOMMENDED ACTION:
Authorize the execution of a Utility Relocation Reimbursement Agreement with CenterPoint LLC, for the relocation of approximately 160 feet of CenterPoint's 6-inch natural gas pipeline for the SH6 Widening Phase III Project, CIP ST1404, in the amount of $8,894.40.
EXECUTIVE SUMMARY:
As the SH6 Widening Phase III Project (CIP ST1404) progresses, right of way (ROW) areas are currently being acquired as necessary for the improvements. The City is in the process of acquiring 44 parcels along the SH6 corridor. The coordination efforts pertaining to easements, ROW acquisition and utility relocations for the project are ongoing.

Per the Advance Funding Agreement (AFA) entered into by and between TxDOT and the City, effective June 4, 2015, the City is responsible for the adjustment, removal, and relocation of utility facilities required by the SH6 Phase III Widening Project, including the reimbursement of eligible utility relocation costs. The SH6 Widening Project will require the relocation of approximately one-hundred sixty feet (160’) of CenterPoint's 6-inch natural gas pipeline presently located within an easement. The City acknowledges that, based on CenterPoint's interest in the easement, the cost of the work is an eligible relocation cost for which CenterPoint is entitled to reimbursement. This relocation must occur prior to road construction for the SH6 Widening Project. The terms of the Reimbursement Agreement are based on actual relocation costs provided by CenterPoint.

Under the terms of the Agreement the following was negotiated between both parties:

CenterPoint Obligations:
CenterPoint will complete the utility relocation within 30 days of the execution of this Agreement.
CenterPoint will submit to the City a detailed statement of its costs for reimbursement.

City Obligation:
City will reimburse CenterPoint for the costs within 45 days after the work has been completed.

Funding is identified in the City’s capital program under CIP No. ST1404.

The Engineering and Legal Departments recommend that the City Council approve the Reimbursement Agreement and authorize the City Manager to execute the attached Utility Relocation Agreement with CenterPoint LLC, for SH6 Widening Phase III, CIP ST1404., in the amount of $8,894.40.
